General Terms and Conditions (GTC)
§ 1 General
The following terms and conditions apply to all orders and purchases that you make from Strampelwicht GbR (hereinafter referred to as Strampelwicht).
§ 2 Order
You place an online order in the shop. The order is binding when you have pressed the "order with payment" button. Please note that a legally binding purchase contract is created.
§ 3 Prices
The prices are shown in euros and include the legally required VAT. The prices stated on the website at the time the order is received apply.
All item information is created with great care.
However, no liability is accepted for errors, e.g. in price information.
§ 4 Delivery
Delivery takes place on working days within 24 hours of receipt of payment, on Sundays and public holidays on the next working day. If an item is not available immediately, we will contact you by email or telephone. You will receive an estimated delivery date from us.
We will endeavor to deliver all ordered items, but we are not obliged to deliver.
Incorrect deliveries or delivery delays do not entitle you to claim damages. Delivery is made to the delivery address specified by the customer. Any additional delivery costs that may arise due to an incorrect delivery address provided by the customer are borne by the customer.
§ 5 Flat-rate shipping costs within Germany
The delivery time for stock items is usually 1-3 working days after receipt of payment.
Delivery is usually made by DHL.
We charge a flat rate of €4.99 for shipments within Germany,
for orders over €75.00 we deliver FREE OF CHARGE.
§ 5.1 Flat-rate costs for international deliveries within the EU
The delivery time for stock items is usually 2-3 working days after receipt of payment.
Delivery is usually made by DHL.
The flat rate for shipments abroad, within the EU, depends on the fees of our shipping service provider for the respective country and can be viewed under delivery and shipping costs in the online shop.
For orders over €1000.00, we deliver FREE OF CHARGE.
§ 5.2 Flat rates for deliveries abroad outside the EU
We will inform you of the shipping costs for deliveries abroad outside the EU on request.
§ 6 Payment via PayPal, direct debit, credit/debit card
Payment is made via PayPal, direct debit or credit/debit card during the ordering process.
§ 6.1 Payment in advance and advance payment bank details
If you choose to pay in advance, we will give you the bank details in the
order confirmation.
The goods will be reserved for you at the time of your order.
After receipt of payment, the goods will be shipped by us.
In the event of any short delivery, any overpaid amounts will be transferred back.
§ 6.2 Purchase on account and "purchase on account" bank details
Strampelwicht has assigned the claim against the buyer to PayPal (Europe) S.àr.l. et Cie, S.C.A. and its partner Ratepay as part of an ongoing factoring agreement.
Payments with a debt-discharging effect can only be made to Ratepay GmbH.
The purchase price is transferred directly to Ratepay GmbH. Ratepay's bank account information can be found on the order confirmation, the invoice and the emails from Ratepay about the purchase.
§ 6.3 Fees for returned direct debits
In the case of returned direct debits in the direct debit process, additional bank fees of €3.00 are incurred for Strampelwicht.
The customer must bear these direct, additional costs.
§ 7 Retention of title
The delivered goods remain the property of Strampelwicht until full payment has been made.
§ 8 Cancellation policy

Right of cancellation
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last partial shipment or the last item.
To exercise your right of cancellation, you must inform us at:

by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to cancel this contract. You can also use the cancellation form that is integrated in our online shop, but this is not mandatory.
To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period has expired.
Consequences of cancellation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.
You must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.
You bear the costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
Exclusion of the right of withdrawal
The right of withdrawal does not apply in accordance with Section 312g Paragraph 2 of the German Civil Code (BGB) for the following contracts:
- Contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (Section 312g Paragraph 2 No. 1 of the German Civil Code),
- Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery (Section 312g Paragraph 2 No. 3 of the German Civil Code),
- The right of withdrawal according to the Distance Selling Act does not apply to purchase contracts between traders and goods purchased in our shop in Mainz.
End of the cancellation policy
§ 9 Warranty
The warranty is based on the statutory provisions. In the event of a justified complaint, the customer has the right to exchange the goods free of charge, but the manufacturer generally has the right to rectify or repair the goods.
§ 10 Data protection
Your data will be treated with the utmost confidentiality. It will not be passed on to third parties. Excepted from this are service partners (e.g. post office or freight forwarder) who require the transmission of data in order to process the order. In these cases, however, the scope of the data transmitted is limited to the minimum required. The customer agrees to the storage of his data in an electronic customer file.
This data will be deleted again at the customer's request.
§ 11 Invoicing
The invoice will be created on the basis of the information provided with your order.
§ 12 Copyrights of the published images
The copyright lies with Strampelwicht or the manufacturers of the items shown. The images used by Strampelwicht on the Internet and in print products are legally protected and may not be used commercially or copied and published by private individuals. Any violation will result in a warning to cease and desist, which will incur a fee.
§ 13 Product presentation
The product photos are selected with the greatest care. Nevertheless, the colors of the images may differ from the colors of the actual items. The presentation depends on the respective settings and different types of hardware.
§ 14 Disclaimer
We carefully check external links. We do not accept liability for the content of the linked pages. Their operators are solely responsible for their content.
§ 15 Applicable law
German law applies. The place of jurisdiction for both parties is Mainz.
§ 16 Online dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before consumer arbitration boards.
